Texas Medical Malpractice Claims Have Strict Deadlines
Texas medical malpractice claims have strict deadlines. Texas Chapter 74 generally requires a healthcare liability claim to be filed within two years of the occurrence of the breach or tort, or the completion of the relevant treatment or hospitalization, subject to statutory exceptions.
Chapter 74 also requires an expert report for each healthcare provider named in the claim. The claimant generally must serve the report within 120 days after that defendant files an original answer.
